18Birdies Golf Cap Design Challenge Official Contest Rules

No purchase or payment of any kind is necessary to enter or win. A purchase will not increase your chances of winning.

Open to eligible legal residents of the 50 United States and the District of Columbia, 18 or older who, as of the time of entry, are enrolled as a student at the Rhode Island School of Design.

Void in all jurisdictions other than those stated above and where prohibited or restricted by law.

  1. Eligibility

    The 18Birdies Golf Cap Design Challenge (the “Contest”) is open only to individuals 18 years of age or older who are (i) enrolled as a student at the Rhode Island School of Design at the time of entry, and (ii) a legal resident of the 50 United States or the District of Columbia. Void in all jurisdictions other than those stated above and where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: employees, contractors, representatives, agents, directors, and officers of 18Birdies, LLC (“Sponsor”) and its parent, subsidiary, and affiliated companies, marketing agencies, and any other parties involved in the administration of the Contest (Sponsor, collectively with the foregoing, the “Contest Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in this Contest, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor and the judges selected by Sponsor in all matters relating to the Contest.

  2. Entry Period

    The entry period for the Contest commences on October 26, 2017 at 12:00:00am PT and ends on November 26, 2017 at 11:59:59 PM PT (“Entry Period”). Sponsor’s computer is the official time keeping device for the Contest. Sponsor reserves the right to amend the Entry Period by updating these official rules and/or by posting a notice on the Contest Page.

  3. How to Enter


    To participate in the Contest, you will need a Gmail account. If you do not have a Gmail account, you may create a free account by visiting https://accounts.google.com/SignUp?hl=en and entering the required information. To enter the Contest, visit www.18birdies.com/design-challenge (the “Contest Page”) during the Entry Period, follow all on-screen instructions for properly completing an online registration form and click the “SUBMIT DESIGN” button for the Contest at the top or bottom of the page to submit your entry.

    Subject to compliance with these Official Rules, there is no limit on the number of eligible entries that you may submit.

    Creative Assignment

    The creative assignment for the Contest (“Creative Assignment”) is as follows:

    Put your thinking caps on to design some golf-themed headwear for today’s modern golfer.

    Your challenge is to design golf caps that can make the mediocre golfer feel like a winner. For each entry, you must design and submit a series of three (3) caps. Use the caps as a canvas to create fresh, original designs that feature bold statements using typography, badges, illustrations, or patterns that inspire people to get out on the course and play. Get in touch with your athletic side and get started!

    Subject to your compliance with these Official Rules and any Sponsor brand guidelines posted on the Contest Page or otherwise communicated to you, Sponsor hereby grants to you the limited, non-exclusive, non-transferable, non-sublicenseable right to use the Sponsor’s 18Birdies logo (shown below) solely as necessary to create one or more eligible entries in the Contest; provided, however, you will not have the right to use the Sponsor’s logo for any purposes, commercial or otherwise, other than to enter the Contest without the separate, prior written consent of Sponsor in each instance. By submitting an entry, you acknowledge that Sponsor retains all right, title and interest in the 18Birdies logo except for the limited and fully revocable grant provided in this paragraph, and that any goodwill resulting from your use of the 18Birdies logo will inure to the benefit of Sponsor. You further agree that you will not attempt to register the 18Birdies logo or adopt, use or attempt to register any mark that is confusingly similar to the 18Birdies logo.

    Sponsor’s 18Birdies logo may be used in the following form, subject to the terms set forth herein:

    Except with respect to the 18Birdies logo, each entry must be the original artwork of the entrant produced for this Contest. Entries must not, and you represent and warrant that your entries will not:

    • have been entered in or won previous contests or awards, or published previously in any medium;
    • contain content that violates or infringes another’s rights, including, but not limited to, privacy, publicity, trademark, trade dress, copyright, design patent or intellectual property rights;
    • disparage Sponsor or any other person or party affiliated with the promotion and administration of this Contest;
    • contain personally identifiable information;
    • contain material or concepts unrelated to golf;
    • contain material or concepts related to politics or religion;
    • contain material that is inappropriate, violent, indecent, lewd, pornographic, profane, obscene, hateful, tortious, defamatory, slanderous or libelous, as determined by Sponsor in its sole discretion; or
    • contain material that is unlawful in any jurisdiction where the entry is created.

    Technical Requirements:

    • Each entry must contain three (3) original cap designs.
    • Each cap design in an entry must contain Sponsor’s 18Birdies logo.
    • Each cap design in an entry must be submitted in the following size and format: 1800 px*1300 px, JPG format (RGB mode).
    • Only “18Birdies Cap Mockup Front View” is required for submission. Other perspective views are optional.

    Be mindful of creating designs with extra fine details. Think about the potential medium your design will be incorporated, for example:

    • Screen printed transfers
    • Screen printed patch
    • Embroidered patch
    • Embroidery
    • 3D embroidery
    • Sublimated all over print
    • Color screen printed pattern

    Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that violate, as determined by the Sponsor, in its sole discretion, the entry requirements or do not meet the entry deadlines will be disqualified from the Contest.

  4. Winner Selection and Notification

    On or about November 29, 2017, one (1) winner will be selected from all eligible entries received during the Entry Period by a panel of judges appointed by Sponsor, whose decisions shall be final. Eligible entries will be judged and rated according to the following criteria: (1) whether the entry is modern and trendy, showcasing golf as a fashion-forward, modern, trendy category through innovative headwear (20%); (2) whether the entry is casual and classy, appropriate for wearing on the street and at the golf course (20%); (3) whether the entry includes unisex designs, which appeal to both men and women (20%); and whether the entry projects the 18Birdies brand image, expressing the fun and innovative voice of Sponsor’s brand (20%). Each judge will assign a score to each eligible entry, and the collective scores of the judges for each eligible entry will be averaged to determine each eligible entry’s actual score. The eligible entry with the highest averaged score will be declared the winner. In the event of a tie, Sponsor reserves the right to break the tie. A Sponsor representative not previously involved in the judging will judge and rank the tied entries based on overall originality and select the winning entry that is the most original. The decisions of the judges are final and binding. Sponsor will notify the winner by message sent to the winner’s email used at the time of registration on or about November 29, 2017.

  5. Prizes and Prize Claim

    One (1) Grand Prize: The Grand Prize Winner will receive a five thousand dollar ($5,000) cash design fee in exchange for the rights and interest in the winning entry granted to Sponsor in these Official Rules.

    The total ARV of all prizes offered in this Contest is five thousand dollars ($5,000).

    Odds of winning depend on number of entries received. The winners are subject to verification, including verification of age, residency, and enrollment status at the Rhode Island School of Design. The design fee prize is non-transferable and no prize substitution is permitted, except at the sole discretion of the Sponsor.

    The winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance of the design fee prize. All costs and expenses associated with the acceptance and use of the design fee prize not specifically provided herein are the responsibility of the winner.

    If the winner (i) is determined to be ineligible or (ii) fails to respond to the initial message regarding the design fee prize within one (1) week of notification or after three (3) attempts (whichever occurs first), the winner forfeits the prize in its entirety and an alternate winner will be selected and announced based upon the judging criteria and process described in section 4 above.

  6. Publicity Rights

    Except where prohibited by law, by accepting a prize, the winner hereby grants Sponsor, and its agents a worldwide, royalty-free, non-exclusive and sublicenseable right and license to use, distribute, and publicly display the winner’s name in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.

  7. Intellectual Property License and Ownership

    By submitting an entry, you hereby grant Sponsor and its affiliates, and their successors, assigns, agents, licensees and others that Sponsor might designate from time to time, the unconditional right, license and permission, on an irrevocable, worldwide, fully paid, royalty free and perpetual basis, and using any media, technology or methods now or hereafter known, to reproduce, publicly display, publicly perform, distribute, digitally transmit, create derivative works of, exploit and otherwise use the Licensed Property, in whole or in part, to administer the Contest and for advertising or promotional purposes relating to the Contest. “Licensed Property” means any cap design submitted to the Contest in connection with an entry. Such permission includes, in particular but without limitation, use of Licensed Property on websites, on social media, and in databases, blogs, brochures, mailers, emails, videos, multi-media works, advertisements, promotions, press releases and other publicity materials, products, services or offerings, in connection with the Contest. You agree that Sponsor is under no obligation to actually use the Licensed Property in any manner, nor to indicate attribution of any kind (although Sponsor and its designees are free to do so, and as Sponsor or such other(s) sees fit). You further agree that you will be entitled to no monetary or other compensation relating to any exercise of the permissions and rights granted, agreed to or acknowledged in this paragraph and you hereby waive and release all claims you might now or hereafter have regarding any such exercise. You agree to promptly execute and return to Sponsor any confirmation, license, verification or other document or instrument Sponsor requests to confirm, further formalize or perfect the rights granted in this paragraph , or any other rights or interests of Sponsor under these Official Rules. You hereby unconditionally and irrevocably waive all, and the enforcement of all, moral rights that you may have, if any, in your entry or entries. You also grant all end users of Sponsor’s website the ability to rate, vote, review, comment on and tag your entry or entries. Entries will not be returned to you after submission.

    If you are selected as the winner of the Contest and you accept the $5,000 design fee offered as a prize, then you will also transfer additional rights to your winning entry to Sponsor in exchange for such fee. By accepting a prize, the winner hereby irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her winning entry, including but not limited to all copyright and trademark rights, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. The winner hereby waives in favor of Sponsor, all moral rights or similar rights or principles of law that the winner may now or later have to his/her entry. Sponsor reserves the right to alter, change, or modify a winning entry, in its sole discretion. Upon request of Sponsor, the winner shall execute and deliver such additional instrument of assignment as Sponsor, in its sole discretion, may deem reasonably necessary to establish the ownership of record of the right, title and interest in and to the entry and of the copyrights transferred and the “moral rights of authors” waived under these Official Rules. Should Sponsor fail to request said additional written assignment document as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the additional assignment document, at which point the winner will provide it.

  8. Limitation of Liability

    By participating in the Contest or accepting a prize, entrants agree that the Contest Parties are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed entries, all of which will be void. Contest Parties are also not responsible for problems related to unauthorized human intervention or for technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, traffic congestion on the internet or any website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled, or misdirected communications, which may prevent the receipt of an entry or otherwise limit an entrant’s ability to participate in this Contest. Contest Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the Contest, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prize or in any Contest-related materials. As a condition of entering, entrants agree (and agree to confirm in writing if requested by a Sponsor) that to the fullest extent permitted by applicable law: (a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, indirect, special, exemplary, or consequential damages and (b) that any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.


    Any attempt by an individual, whether or not an entrant, to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, sponsor reserves the right to seek damages and diligently pursue all remedies against any such individual to the fullest extent permitted by law.

  10. Sponsor’s Reservation of Rights

    If the Contest is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process or otherwise acts in violation of these Official Rules, and to cancel, modify, or terminate the Contest.

  11. Governing Law and Jurisdiction

    All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. By entering, you consent to the jurisdiction and venue of the state and local courts located in Alameda County, California and the federal courts located in the Northern District of California for the resolution of all disputes, and agree that any and all disputes shall be resolved exclusively in those courts. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

  12. Privacy

    Any personally identifiable information collected during an entrant’s participation in the Contest will be collected and used by Sponsor and its designees for the proper administration and fulfillment of the Contest, in accordance with Sponsor’s privacy policy available at https://18birdies.com/privacy-policy/, and as otherwise described in these Official Rules.

  13. Winners’ List

    For the name of the winner, send an e-mail to designchallenge@18birdies.com. Requests must be received no later than sixty (60) days after the end of the Entry Period.
